Titan Locators Privacy Policy

 

No Refund Policy

This No Refund Policy (“Policy”) sets forth the terms and conditions governing refunds, chargebacks, and cancellations for all data products, lead deliveries, subscriptions, pilots, and related services (collectively, “Data Products” or “Services”) provided by Titan Locators. By purchasing or accessing any Data Products, you agree to this Policy.

1) All Sales Final — No Refunds

All sales are final. Due to the digital nature of Data Products and the immediate value transferred upon delivery or access, Titan Locators does not offer refunds, returns, or exchanges for any reason once:

  • Data has been delivered (in whole or in part),
  • Access to data, samples, schemas, or delivery mechanisms has been granted, or
  • A pilot, subscription, or recurring delivery has commenced.

This includes, without limitation, refund requests based on:

  • Marketing performance or results
  • Conversion or contact rate
  • Internal staffing or usage delays
  • Speed-to-lead or contact cadence
  • Channel limitations or compliance constraints

2) No Chargebacks

You agree not to initiate a chargeback or payment reversal for delivered Data Products or Services. If you believe a billing error has occurred, you must first contact Titan Locators using the contact information in Section 9.

Unauthorized chargebacks may result in immediate access termination and legal action to recover owed amounts, transaction costs, and attorney’s fees. Termination does not waive outstanding payment obligations.

3) Performance Disclaimer

Titan Locators makes no guarantees regarding:

  • Conversion rate
  • Revenue
  • Response rate
  • Engagement outcomes

Performance may vary depending on factors beyond Titan Locators’ control, including but not limited to:

  • Offer quality and price
  • Sales strategy and staff execution
  • Contact speed and cadence
  • CRM/campaign setup or targeting
  • Channel compliance requirements

Purchases are made with full acknowledgment that results may vary.

4) Limited Remedy for Material Nonconformity (Correction/Re-Delivery Only)

If Titan Locators confirms that a delivery materially fails to meet the express specifications set forth in the applicable invoice, Order Form, or signed agreement, the sole and exclusive remedy is correction and re-delivery of the affected portion.

Exclusions:

No correction/re-delivery will be granted for:

  • Performance-related concerns (e.g., ROI, engagement, response rate)
  • Buyer-side technical issues (e.g., CRM import, system incompatibility)
  • Compliance or outreach restrictions imposed by Buyer’s vendors or industry
  • Shifting Buyer needs after delivery preparation
  • Duplicate Leads, except where explicitly defined and confirmed under agreement terms

5) Reporting Window (Notice Requirement)

To be eligible for any correction or replacement, written notice must be submitted within three (3) business days of delivery. Notice must include:

  • Delivery date and reference (invoice/order number)
  • A description of the issue
  • Examples or screenshots evidencing the issue
  • A copy of the agreed-upon specifications

Titan Locators will respond within a commercially reasonable timeframe.

6) Cancellations and Termination

One-Time Purchases

Cannot be canceled once delivery has occurred or access has been granted.

Recurring Deliveries / Subscriptions

You may cancel future deliveries by submitting written notice per the cancellation terms defined in your invoice, order form, or agreement. Fees already paid are non-refundable.

Titan Locators may suspend or terminate access for nonpayment, breach, or prohibited use. No refunds will apply in these scenarios.

7) Disputes and Governing Law (Texas)

This Policy is governed by the laws of the State of Texas. All disputes shall be brought in the state or federal courts of Harris County, Texas, and each party hereby consents to the personal jurisdiction of such courts.

8) Changes to This Policy

Titan Locators may revise this Policy at any time. The “Last Updated” date reflects the most recent version. Continued access or purchases after such changes constitute acceptance of the updated Policy.
