No Refund Policy

This No Refund Policy (“Policy”) explains Titan Locators’ position on refunds, returns, and chargebacks for all data products, lead deliveries, subscriptions, pilots, and related services (collectively, “Data Products” or “Services”). By purchasing from Titan Locators or receiving access to Data Products, you agree to this Policy.

1) All Sales Final — No Refunds

All sales are final. Due to the digital nature of Data Products and the immediate value transferred upon delivery and/or access, Titan Locators does not offer refunds, returns, or exchanges for any reason once:

  • Data has been delivered (in whole or in part), and/or
  • Access to data, samples, schemas, or delivery mechanisms has been granted, and/or
  • A pilot, subscription, or recurring delivery has begun.

This includes, without limitation, refunds based on marketing performance, conversion rate, contact rate, response rate, internal staffing, speed-to-lead, or channel restrictions.

2) No Chargebacks

You agree not to initiate a chargeback or payment reversal for delivered Data Products or granted access. If you have a billing question or believe there was an error, you must contact Titan Locators first using the contact information below. Unauthorized chargebacks may result in immediate termination of access and/or legal action to recover amounts owed and associated costs.

Termination of access does not excuse payment obligations for delivered Data Products or Services.

3) Performance Disclaimer

Titan Locators does not guarantee any specific marketing or sales outcome. Results may vary based on factors outside Titan Locators’ control, including but not limited to:

  • Offer quality and price
  • Speed-to-lead and contact strategy
  • Call center and sales process execution
  • Channel policies and compliance requirements
  • Targeting choices (geography, filters, cadence, volume)

Purchases are made with the understanding that performance outcomes are not guaranteed.

4) Limited Remedy for Material Nonconformity (Correction/Re-Delivery Only)

If Titan Locators confirms that a delivery is materially nonconforming to the written, agreed-upon specifications, Titan Locators will provide correction and re-delivery of the affected portion as the exclusive remedy. No refunds will be issued. For purposes of this Policy, “written, agreed-upon specifications” means the specifications expressly set forth in the applicable invoice, Order Form, or executed written agreement (including any required fields explicitly agreed).

Correction/re-delivery is not available for:

  • Performance-related concerns (conversion rates, ROI, response rates, etc.)
  • Buyer-side technical issues (CRM mapping, import errors, campaign setup)
  • Buyer-side compliance restrictions, legal compliance limitations, or channel blocks
  • Changes in buyer requirements after delivery is prepared or delivered

Duplicate Leads. If Titan Locators confirms delivered records contain duplicates as defined in the applicable agreement, Titan Locators will provide replacement data as the exclusive remedy, subject to the notice requirement in Section 5.

5) Reporting Window (Notice Requirement)

To be eligible for any correction or replacement, written notice must be submitted within three (3) business days of delivery. Notice must include: Delivery date and reference (invoice/order number), A description of the issue, Examples or screenshots evidencing the issue, A copy of the agreed-upon specifications. Titan Locators will respond within a commercially reasonable timeframe. 

  • Delivery date and identifier (invoice/order reference if available)
  • A description of the issue
  • Evidence showing nonconformity (e.g., screenshots, field mapping, sample lines)
  • The agreed-upon specs you believe were not met

Titan Locators will review and respond within a commercially reasonable timeframe.

6) Cancellations and Termination

One-time purchases

One-time purchases cannot be canceled once delivery has occurred or access has been granted.

Recurring deliveries / subscriptions

If you are on a recurring delivery schedule, you may request cancellation of future deliveries in writing. Cancellation terms (including notice periods) are defined in your invoice, order form, or written agreement. Fees already paid are not refundable.

Titan Locators may suspend or terminate service for nonpayment, prohibited use, or breach of applicable terms. No refunds apply in these situations.

7) Disputes and Governing Law (Texas)

This Policy is governed by the laws of the State of Texas, without regard to conflict of laws principles. Unless otherwise required by law, any dispute relating to this Policy will be brought in the state or federal courts located in Harris County, Texas, and the parties consent to the personal jurisdiction of such courts.

8) Changes to This Policy

Titan Locators may update this Policy from time to time. The “Last Updated” date reflects changes. Continued purchases or use of the Services after an update constitutes acceptance of the updated Policy.
